Tenant not paying rent in Flanders: what to do
Published
Act on the first missed rent, not the third. In Flanders the sequence runs in steps: a plain reminder first, then a registered formal notice (ingebrekestelling) naming the exact amount and months, then a repayment plan if the tenant is willing but unable, and only when that fails a conciliation or a claim before the justice of the peace (vrederechter). There is no statutory threshold in months of arrears: the justice of the peace weighs the seriousness of the default and the circumstances case by case. In practice two to three months of arrears weigh heavily, and a registered formal notice is not a legal prerequisite but the evidence the judge wants to see. Every step rests on the same evidence: which months are unpaid, how much is outstanding, and when you wrote to the tenant about it.
Reminder and formal notice
Send the first reminder informally, by email or message, as soon as the rent is a few days late. Much arrears starts as a forgotten transfer. If payment still does not arrive, send a registered formal notice: name the lease, the outstanding months, the total amount and a deadline to pay. That letter is the starting point of any later procedure and also starts default interest running.
Repayment plan and the OCMW
If the tenant wants to pay but cannot do it in one go, a written repayment plan is often faster and cheaper than a procedure. The Flemish government publishes a model agreement for it. The municipal welfare office (OCMW) can mediate and in some cases advance part of the arrears.
The justice of the peace
If that does not help, you ask the justice of the peace for a conciliation or file a claim for payment of the outstanding rent and, if it comes to that, termination of the lease and eviction. Rent arrears lapse after five years, so old months remain recoverable, but the longer you wait, the larger the amount and the smaller the chance of recovering all of it.
Where UnitDesk helps
In UnitDesk the evidence comes out of the payment tracking itself. Each lease shows which months are paid, partially paid or open, with the amount per month, because imported bank transactions are matched to the right lease. For the formal notice you copy that list; at the end of the lease you record a deduction from the deposit for unpaid rent, so the settlement matches what was still outstanding.
